The general rule is you need a license to operate a transmitter that has an RF output power of over 50 Mill watts. Just about any business two-way radio fits this category. There are few exceptions, but there are some. You don’t need a license to operate the FRS (family radio services) walkie-talkies you buy at the discount store. You don’t need a license to operate a cell phone or if you rent airtime from a trunked two-way radio operator on a legal SMR system.
